General Terms and Conditions (GTC) for Consumers

§ 1 Scope of Application

These General Terms and Conditions (hereinafter "T&Cs") apply to all contracts concluded via the online shop aiershatoys.com, operated by:

Our offer is directed exclusively at individual consumers (B2C) who have reached the age of 18. By placing an order, you confirm that you are of legal age and have the legal capacity to act. Deviating, conflicting, or supplementary T&Cs of the customer will not become part of the contract unless expressly agreed to in writing.

§ 2 Conclusion of Contract

The presentation of goods in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy Now" (or similar) button, you submit a binding order. A binding contract is only concluded when we accept your order by a separate email (order confirmation) or upon delivery of the goods.

§ 3 Prices, Taxes, and Customs

The prices stated in our online shop are final prices. However, the following rules apply depending on your location:

• US Customers: Prices are shown exclusive of Sales Tax. Sales Tax is calculated based on your shipping address and added during checkout.
• EU Customers (Orders under €150): If we collect VAT through the IOSS system, the VAT of your destination country is included in the price.
• EU Customers (Orders over €150) & Switzerland: Prices are shown Net (exclusive of VAT/GST). You are responsible for all import VAT, customs duties, and local handling fees required by your local authorities upon arrival.
• Shipping Costs: These are shown separately and are to be borne by the customer.

§ 4 Payment Terms

Payment can be made via Credit Card (Visa, Mastercard, Amex), PayPal, Apple Pay, and Google Pay. The selection of the payment method takes place during the ordering process. Your account will be debited immediately upon completion of the order. For international transactions, your bank may apply currency conversion fees.

§ 5 Delivery and Shipping

Unless otherwise agreed, the goods will be delivered to the delivery address provided. Goods are dispatched from our fulfillment centers (USA or China). Delivery usually takes 7 to 15 business days. Please note that delays may occur due to international shipping and customs processes. The risk of accidental loss or accidental deterioration of the goods is transferred to you upon delivery of the goods to the carrier.

§ 6 Youth Protection

The sale of erotic articles is legally only permitted to persons over 18 years of age. By submitting your order, you confirm that you are of legal age. We reserve the right to carry out an age verification and to refuse orders if there are doubts about the customer's age.

§ 7 Right of Withdrawal (Consumers in the EU only)

Instructions on Withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The period starts from the day you take possession of the goods.

To exercise this right, inform us (AIERSHA WELLNESS INC, 30 N Gould St Ste R, Sheridan, WY 82801, USA, info@aiersha.com) via a clear declaration. You bear the direct costs of returning the goods. Exclusion: For reasons of health protection or hygiene, sealed goods are excluded from the right of withdrawal if their seal has been removed after delivery.

§ 8 Warranty and Consumer Returns

Warranty: We offer a one-year warranty for consumers on manufacturing defects. This warranty does not cover damage caused by misuse, improper handling, or normal wear and tear.

Returns: Due to the intimate nature of our products, we cannot accept returns for opened or used items. All consumer sales are considered final once the hygienic seal is broken, except in cases of proven manufacturing defects.

§ 9 Liability

We are liable without limitation for damages based on intent or gross negligence, and for damages resulting from injury to life, body, or health. Liability for damages caused by slight negligence is excluded, except in the case of a breach of essential contractual obligations. In this case, liability is limited to the typically foreseeable damage.

§ 10 Data Protection

We collect, process, and use your personal data in accordance with the legal provisions. Detailed information can be found in our separate Privacy Policy, which complies with the requirements of the GDPR (for EU users) and the CCPA (for US users).

§ 11 Final Provisions

The law of the United States and the State of Wyoming applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For customers residing in the EU, the mandatory consumer protection provisions of the respective EU country remain unaffected. The place of jurisdiction is Sheridan, Wyoming, USA.
